Article 40 - Surrogacy
Surrogacy is the term used to define both the circumstance and legal arrangement whereby a female of a species carries and delivers an infant for another couple or individual.
As a legal arrangement (Consensus), Surrogacy is a Bilateral Consensus whereby a woman as the Host Mother agrees to raise through Pregnancy an embryo produced from genetic material of certain Biological Parents to full term on behalf of Social Parents.
The primary justification for Surrogacy with Homo Sapiens is to provide assistance to heterosexual couples when the female is completely unable to conceive via a viable pregnancy and thus unable to use Artificial Insemination options.
There are genetically two (2) possible forms of Surrogacy from the perspective of the Host Mother being Biological (traditional) and Gestational:
(i) Biological is when the Host Mother is also the biological mother of the infant; and
(ii) Gestational is when the Host Mother has no biological connection to the embryo and merely carries it to term.
Where the Host Mother is also the Biological Mother, then the Host Mother is also the Legal Mother and the surrogacy consensus must be applied in similar terms of any adoption agreement, with the Biological Mother possessing the intrinsic right to change the terms of the agreement within fourty (40) days of birth and apply for possession of the new born infant.
The use of Surrogacy by a healthy and fertile woman as a means of securing another woman to carry to pregnancy her fertilized egg (embryo) as an alternative to falling pregnant herself is contrary to the norms of society and the original intention of Surrogacy and is forbidden, to be suppressed and not permitted to be revived.
The use of Surrogacy by an older female of forty (40) years or greater as a means of by-passing restrictions on Artificial Insemination and for compensating for lack of earlier family planning is forbidden, to be suppressed and not permitted to be revived.
The use of Surrogacy as a means of a same sex couple obtaining an infant is forbidden, to be suppressed and not permitted to be revived.
