Article 56 - Oratorium
All judicial plenary authority of Heaven, the Galaxy, the Solar System and Earth shall be vested in one supreme spiritual body, court of record and competent forum of Law known as the Oratorium, also known as the Supreme Court and also known as the Supreme Court of One Heaven. The Oratorium is by definition the highest See and is judged by no one.
It is the sole right of the Oratorium itself to judge in all matters of Law upon any claim of Law, or Rights or Justice or Jurisdiction being spoken or written. All other judicial bodies, forums, assemblies, courts and tribunals are subject to the supreme jurisdiction of the Oratorium.
The word “Oratorium” originally comes from Latin and means “a place for the vocalization of prayer; a place for the vocalization of law; a place of public speaking and formal debate”. In Latin, a public speaker is known as an “orator”.
When anyone references, writes or speaks of Oration, Oratories or the vocalization of Prayer or Law in general, it shall mean this body and no other.
The Oratorium, also known as the Supreme Court of One Heaven shall consist of twelve (12) spiritual Justices, with four of these twelve appointed by The Unique Collective Awareness of Divine Mind and eight appointed upon the approval of the duly elected representatives of all the Higher Order Life forms at a Great Conclave every one hundred twenty eight (128) years, excluding the foundation period.
During the foundation period of the Supreme Court, the Court shall consist of four (4) spiritual Justices appointed by The Unique Collective Awareness of Divine Mind for a period of not greater than three thousand two hundred ten (3210) years, consistent with the cycle until the next Supreme Conclave.
Excluding the four Justices appointed during the foundation period, the tenure of a Justice of the Supreme Court shall be for a period of not greater than one hundred twenty eight (128) years, consistent with the cycle of a Great Conclave.
In accordance with the present Covenant, the Oratorium cannot be separated, sold, disbanded, suspended, conveyed, alienated, seized, arrested, salvaged, captured, gifted, privatized or any other act that would derogate or abrogate its functions.
Vested by the present Covenant, the Oratorium, possesses supreme, full, immediate, and universal ordinary powers as the Rights of Ius Divinum Oratorium being:
Original Jurisdiction
The Oratorium as the original Court of Record and Competent Forum of Law shall have first, supreme, immediate and final jurisdiction in all matters:
(1) Arising under the present Covenant, or involving its interpretation; and
(2) Arising under any Canon of Law as defined by Divine Canon Law, also known as Astrum Iuris Divini Canonum; and
(3) Arising under any associated Covenant, Charter or Code(s) of Law to the present Covenant and Divine Canon Law also known as Astrum Iuris Divini Canonum; and
(4) Arising under any laws made by the Divina or Universus; and
(5) Arising under any laws, or rights or jurisdiction, or claimed laws, or rights or jurisdiction of any and all bodies politic, aggregates, entities, estates, companies or corporations; and
(6) Arising under any office, or agency or position of trust claiming any form of power or authority under a form of law; and
(7) Arising under any form of trust, or estate, or fund of any company, or corporation, or body politic, or body corporate, or aggregate; and
(8) Arising under any treaty with any higher order spirit(s) or treaty with the Divine Creator; and
(9) Between regional collective bodies of One Heaven, or between residents of different or lesser bodies of One Heaven, or between a regional collective body of One Heaven and a member of another regional body of One Heaven; and
(10) Between regional bodies of One Heaven and any foreign non-Homo Sapien spiritual entity; or any member of a non One Heaven Homo Sapien collective; and
(11) Of any question of Divine Law, Divine Jurisdiction, Moral or Spiritual Authority; and
(12) Of any question or challenge of Supreme and Ultimate Jurisdiction or Challenge of Authority and Mandate; and
(13) Affecting consuls or other representatives of other non Homo Sapien spiritual beings; and
(14) Arising from any statutes, laws and historic instruments of any non Ucadian society that is based upon a claimed treaty with any higher order spirit(s) or the Divine Creator, or claimed Rule of Law.
Appellate Jurisdiction
The Oratorium shall represent the final and conclusive competent forum and court of appeal in all matters determined from all matters of law, judgments, decrees, orders, or sentences:
(1) Of any Justice or Justices exercising the original jurisdiction of the Supreme Court; and
(2) Of any other lesser court of One Heaven and Ucadian Societies or of the Supreme Court of any Ucadian Society; and
(3) Of any court of any non Ucadian society where one (1) or more parties redeem their membership and pledge their obedience to the superior standing of the Covenant of One Heaven and the Laws of Ucadia.
By virtue of the powers and functions defined in this Covenant, it shall be a principle purpose of the Divina and Universus to make laws and a principle purpose of the Supreme Court to preside and judge over cases brought regarding to these laws. This is a principle of the separation of powers.
In so far as judgments of the Supreme Court affect the function and effect of the laws of the Universus and the Bodies of One Heaven, the Court shall not be permitted to use its verdicts as an alternative means of creating new law or regulation.
However, it shall be considered a primary role of the Supreme Court to ensure that the laws of One Heaven and the new covenant at all levels reflect the good principles of this Covenant and the fair principles of justice.
Where laws by the Government or by the Universus in anyway contradict the principles of this Covenant and / or fails to execute effectively its function or purpose it shall be considered a requirement of the Supreme Court to ensure that such laws are annulled and any such record voided.
The Oratorium shall commence its first Session from the Day of Agreement and Understanding being GAIA E8:Y3209:A1:S1:M6:D1, also known as [Monday, 21 Dec 2009] and shall remain in session for a further three thousand two hundred ten (3210) years until the next Supreme Conclave. Thereafter, the Oratorium shall commence its next Session upon the first day of the next Supreme Conclave.
There shall exist two (2) types of Session Days within a Session being Special and Ordinary:
(i) A Special Session Day is a day whereby the Oratorium as the Supreme Court of One Heaven may sit and adjudicate a matter of law corresponding to the convening of a competent forum of law within the temporal realm of existence by twelve or more Members of Ucadia, each having envoked and memorialized an Oath and Vow to uphold the Golden Rule of Law and the Laws of Ucadia and thus represent the true Law; and
(ii) An Ordinary Session Day is a day whereby the Oratorium is open to accepting and hearing every and all legitimate cases vocalized or written by a single Member of Ucadia in accordance with these articles, with the Ucadia Member having envoked and memorialized an Oath and Vow to uphold the Golden Rule of Law and the Laws of Ucadia and thus represent the true Law.
A claimed temporal legal matter not acknowledged as having been heard before the Oratorium is invalid and has no ecclesiastical or legal or lawful effect.
Excluding the foundation period of the Oratorium, in relation to all matters of original jurisdiction, the minimum number of justices required to preside in matters of Original Jurisdiction shall be six (6), excepting in matters of Appeal where all twelve (12) justices shall be required to preside.
During the foundation period of the court, the Quorum on matters of Original Jurisdiction and Appeal shall be permitted to be three (3) judges.
The Oratorium as the One Heaven Supreme Court shall exist both spiritually and temporally whenever and wherever a Special Session or Ordinary Session is properly envoked and called. Thus, the place of the Oratorium and therefore the existence of the Spirit of true Law shall be the same place where a competent forum of law is convened as a Special Session or Ordinary Session in accord with the present Covenant.
The Foundation Period of the Supreme Court shall be from the Day of Divine Agreement being GAIA E8:Y3209:A1:S1:M6:D1, also known as [Monday, 21 Dec 2009], until the end of the Year of Redemption UCA E1:Y2:A1:S1:M30:D1, also known as [Sat, 21 Dec 2013].
The Founding Justices shall be the four (4) Divine Messengers, also known as the four (4) Divine Justices and the four (4) Divine Apostolic Prothonotary being:
1st Divine Justice and Apostolic Prothonotary, Member Number [981205-320915-010001]
2nd Divine Justice and Apostolic Prothonotary, Member Number [000000-000002-000028]
3rd Divine Justice and Apostolic Prothonotary, Member Number [000000-000002-000084]
4th Divine Justice and Apostolic Prothonotary, Member Number [000000-000000-000193]
An Ordinary Session of the Oratorium is called when a Member of Ucadia envokes and memorializes a proper Oath and Vow to the Golden Rule of Law; and the Laws of Ucadia; and becomes an Ordinary representing the True Rule of Law.
When such an action occurs in good trust, good conscience and good intention, a Court of Conscience is convened within the temporal realm as the highest possible temporal court and forum of law, also known as the Curia Conscientiae (Court of Conscience). No other competent forum, or court within temporal existence may claim higher original jurisdiction in all matters of law relating to the specific Member as Ordinary.
A Member ceases to be an Ordinary and the Curia Conscientiae (Court of Conscience) ceases to be in session upon one or more acts of injury against the true Rule of Law, or breach of trust, or willful acts of ignorance, or bad intention or breaches of their Oath and Vow.
When no proper Oath and Vow is envoked and memorialized, no session of the Oratorium is held and Curia Conscientiae (Court of Conscience) is called.
A Special Session of the Oratorium is called when three or more Members of Ucadia individually envoke and memorialize a proper Oath and Vow to the Golden Rule of Law and the Laws of Ucadia and becomes a Tribunal representing the True Rule of Law.
When such an action occurs in good trust, good conscience and good intention, a Divine Court (Curiam Divina) is convened within the temporal realm as the highest possible court of appeal, the second highest court of original jurisdiction and forum of law, also known as the Curia Iuris (Court of Justice). No other competent forum, or court within temporal existence may claim higher appellate jurisdiction in all matters of law.
A Tribunal ceases to be and the Court of Justice (Curia Iuris) ceases to be in session upon one or more acts of injury against the true Rule of Law, or breach of trust, or willful acts of ignorance, or bad intention or breaches their Oaths and Vows.
