1 | A law is a rule that prohibits or permits certain acts. |
2 | A rule is a norm, bar, maxim, measure or standard. |
3 | A rule may be derived by instruction, discovery, custom or consent. |
4 | The highest law is Divine Order. |
5 | As nothing may contradict such a rule. |
6 | The second highest law be the reason of Mind. |
7 | As nothing absurd may be considered law. |
8 | The third highest law be the law of the people. |
9 | As the consent and will of the people is the source of true authority. |
10 | The weakest rule is that of a tyrant. |
11 | As any rule is without authority or right but merely by force. |
12 | These then be the foundations of Rule of Law: |
13 | All law be spoken as it is the spirit of the word that carries the authority; |
14 | All action under law be by word of mouth; |
15 | Writing be only for memory and trade and never be the law; |
16 | All are equal under the law; |
17 | All are accountable and answerable under the law; |
18 | All are without blemish until proven culpable; |
19 | Where there is a law, there must be a cause; |
20 | Where there is a law, there must be a penalty; |
21 | Where there is a law, there must be a remedy; |
22 | An action in law cannot proceed without first a cause; |
23 | An action is not granted to one who is not injured; |
24 | The acts of valid law can do no injury (wrong); |
25 | Acts decided in law must reflect cause of action; |
26 | No injury to law no reason (cause) for action by law; |
27 | An action through law cannot arise from a fraud; |
28 | An action through law cannot arise in bad faith or prejudice; |
29 | No one is bound to accuse himself; |
30 | The acts does not make one culpable unless there be intent to do wrong; |
31 | No one may suffer punishment for mere intent; |
32 | No one is punished for the transgression of another; |
33 | No one can derive an advantage in law from his own wrong; |
34 | What is invalid from the beginning does not become valid over time; |
35 | No one is accused of the same exact cause twice; |
36 | What is done out of necessity to defend ones own life and house is lawful and legal; |
37 | No man be a judge over his own matter; |
38 | No man be both judge and executioner; |
39 | No penalty may exist without a law; |
40 | Justice never contradicts the law; |
41 | The immediate cause and not the remote cause. |
42 | These be the foundations of Rule of Law. |
